EVENT TERMS AND CONDITIONS

These Event Terms govern Conscious Consulting Pty Ltd trading as Healthy Happy Wonderful ACN 167 459 878 ("Healthy Happy Wonderful, We, Our or Us") and each person ("Attendee, You or Your") who has either: (1) purchased a ticket for an Event; (2) registered for an Event; (3) expressed interest in an Event; or (4) been invited by Healthy Happy Wonderful to attend an Event.

These Event Terms apply to any Events occurring on or after 14 November, 2018.

All Healthy Happy Wonderful Event tickets are issued subject to these terms and conditions of sale and entry. By purchasing tickets and/or attending any Healthy Happy Wonderful Event(s) the purchaser and any Attendee agree to comply with these terms and conditions.

1.Payment

Payment in full is required at the time of booking. No admittance will be granted where payment has not been received in full.

All Events are priced in Australian dollars and include Goods and Services Tax (GST).

2. Cancellation or non-attendance by You

All Healthy Happy Wonderful Event tickets are transferrable to other people. If You are unable to attend an Event, You may send someone else in Your place at no extra charge.

Please email jenna@healthyhappywonderful.com to let Us know the name of the person who will be attending in Your place.

All Healthy Happy Wonderful Event tickets are non-refundable. Non-attendance of any Event due to illness, or for personal or professional reasons does not provide the right to refunds, or a transfer to another Event.

3. Change or Cancellation by Us

We reserve the right at any time to change the location, date, and/or time of the Event, postpone the Event, cancel the Event.

If We cancel an Event, You will be notified via the email address used to secure Your booking. A full refund will be provided within 14 days.

If We alter the date, time or location of an Event, You will be notified via the email address used to secure Your booking. You will have the option to attend the altered Event, or You may request a refund in your absolute discretion.

Our maximum liability is limited to a full refund of the Event ticket cost or registration fee. We accept no additional liability for travel, accommodation or any other additional costs incurred.

Any refunds will be returned via the same payment method as the original receipt of funds.

4. Your rights and obligations

We aim to create a safe, informative and enjoyable experience for all attendees.

We will not photograph You, or subject You to video or audio recording, without first seeking and obtaining Your permission.

You agree to comply with all reasonable instructions issued by Us for the Event.

We reserve the right, without any liability, to refuse admission to, or to eject You from the Event, in Our absolute discretion, including (without limitation), for failure to comply with these Event Terms or if in Our opinion You represent a security risk, nuisance or annoyance to the running of the Event.

You may take still photographs of yourself, your own work and food prepared during Our Events, but you may not take photographs or make video or audio recordings of other people present at Our Events.

Information conveyed, and the experience created, during our Events are the intellectual property of Conscious Consulting Pty Limited. You may not make any video or audio recordings of any part of Our Events, or otherwise copy or reproduce our intellectual property in whole or in part without the express written authority of Conscious Consulting Pty Limited.

5. Limitations of Liability and Indemnity

Provisions of the Competition and Consumer Act 2010 and other laws in force from time to time in Australia may impose guarantees, warranties, conditions and obligations on Us ("Consumer Guarantees"). If any of these Event Terms are inconsistent with a Consumer Guarantee, the Consumer Guarantee will apply to the extent of such inconsistency. To the extent permitted by law Our liability and Your sole remedy will be limited to the refund of the ticket price paid to Us. Subject to any applicable Consumer Guarantees, all guarantees, representations, conditions and warranties of any nature are expressly excluded.

Subject to any Consumer Guarantees and to the maximum extent permitted by applicable law, Conscious Consulting Pty Limited, its directors, employees, agents and contractors will not be liable for personal injury or death, property damage, or any other loss (including without limitation, liability for negligence, breach of these Event Terms or any other agreement), damage, cost or expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or damage) that You may incur or suffer arising out of or in connection with the Event.

You agree to fully indemnify and hold Conscious Consulting Pty Limited, its directors, employees, agents, contractors and sub-contractors ("Representatives") harmless from any claim, cost, demand, liability or damage (including legal costs, professional costs and other expenses on a full indemnity basis) incurred by Conscious Consulting and/or its Representatives arising out of or in connection with the Event, including but not limited to: (1) a breach of these Event Terms; (2) Your use of the venue or attendance at the Event; (3) any damage to the venue or any goods located at the venue; or (4) the infringement of any intellectual property or other right of any third party (including the venue) by You.

6. General

We reserve the right to amend these Event Terms from time to time and You will be subject to the terms in force at the time You register for the Event or You attend the Event, if You do not need to Register, whichever is applicable.

Any failure, delay or relaxation on the part of a party in exercising, in part or whole, any power, right or remedy conferred upon that party by these Event Terms shall not operate as a waiver of that power, right or remedy.

If any provision of these Event Terms is invalid or not enforceable by a court of competent jurisdiction, the relevant term is to be read down and shall otherwise be capable of being severed to the extent of the invalidity or unenforceability without affecting the remaining provisions of these Event Terms.

These Event Terms are governed by and are to be construed in accordance with the laws in force in New South Wales. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New South Wales and waives any objection that it may have that proceedings have been brought in an inconvenient forum.

7. Privacy

We are committed to protecting Your privacy and the confidentiality and the security of personal information provided by You. The personal information You provide is necessary to process Registration for the Event. We may use Your personal information to contact You to obtain feedback on the Event, request an attendee testimonial, provide you with information on future events and courses, discount offers and competitions, and to generally provide You with information on Our services and offerings. Your personal information may be collected to enable You to access and use a Healthy Happy Wonderful online course or platform.

You have the right to access or correct any personal information We hold about You (subject to any applicable legal exceptions) and can do this by emailing jenna@healthyhappywonderful.com
